Catering hatch judged to impede highway

An enforcement notice requiring removal of a food hatch opening onto a pavement in an Isles of Scilly conservation area has been upheld after an inspector decided that it undermined highway safety.

The inspector accepted that the opening in a bow window did not adversely affect the conservation area's character. However, he was concerned that it would encourage customers to congregate outside the premises waiting to be served. He saw a risk that they would spill onto the highway and obstruct traffic, placing other pedestrians in danger from moving vehicles.
