Casebook: Appeal Case - Agricultural development - Height bar scuppers farm manure compound

An inspector has upheld an enforcement notice requiring the demolition of an unauthorised manure compound at a farm used as a livery in West Yorkshire after concluding that it was not permitted development.

The compound comprised three concrete panel walls from 2m to 2.5m high. The inspector was satisfied that it involved a building operation and was not permitted development under class 6, part 2, schedule 2 of the General Permitted Development Order 1995 because the means of enclosure exceeded 2m in height. In his view, it was not clear that the facility was necessary for agricultural purposes on the holding, taking it outside class 6 rights.
