Casebook: Appeal Case - Agricultural development - Polytunnel judged essential at chilli farm

Enforcement action taken against a polytunnel at a farm in Hampshire has been quashed after an inspector held that the structure was reasonably necessary for the purposes of growing chilli seeds and its visual impact was acceptable.

The appellant, who operated a specialist organic facility producing chilli seeds, plants and chilli-based products, predicted that revenue would increase over the next three years through internet sales. He argued that the peppers would only ripen under glass or plastic in the British climate.

The inspector agreed that the polytunnel was essential. Although the site lay in an area of special landscape quality, he observed that the polytunnel could only be viewed from one footpath.
