Casebook: Court cases - Traveller action suspended pending appeal hearing

Surrey Heath Borough Council has reached a compromise on a travellers' site after agreeing to suspend injunction proceedings until a planning appeal is heard.

The council had issued enforcement notices in March 2002 and was granted an injunction to have the 15 travellers removed. However, it agreed to postpone its action to get them evicted until the travellers had an opportunity to pursue a planning appeal. If the appeal fails, the travellers will have two months to move off the site and a further four to restore it to its former condition.
