Darlington retail park blocked

A proposed 150ha retail park on the outskirts of Darlington has been blocked following a High Court ruling last week.

Lingfield Properties, which secured planning permission for the scheme in 1991, claimed that pegging out of a roadway and earth-moving works in 1996 had kept the permission alive. But Mr Justice Mitting backed Darlington Borough Council's argument that the alleged commencement works breached planning control because the developer failed to comply with conditions requiring the authority's approval of detailed plans.
