Casebook: Court cases - Gypsy removal halted pending full challenge

The High Court has granted an injunction preventing the removal of Gypsy families at Cottenham, Cambridgeshire, pending a challenge to enforcement notices.

The site had been occupied by Gypsies without planning permission. Roads and hardstandings had been created together with the laying on of basic services. Mr Justice Collins decided that evictions should not occur until the occupants had brought their legal challenge against the enforcement notices. He warned that the courts would not stand for growing incidents of Gypsies and travellers occupying sites without permission, stating that such action was inappropriate in any circumstances and tantamount to "aiming a pistol at the local authority's head".
