Casebook: Appeal cases - Mixed Use Development - Live-work units fail due to loss of protected trees

An appeal involving the development of live-work units on land allocated for employment purposes in Essex has been rejected by an inspector who determined that it would lead to an unacceptable loss of protected trees.

The inspector agreed with the appellants that the provision of 50 per cent of the area for employment use was excessive and might affect the proposal's viability. The 20 per cent figure put forward by the appellants was reasonable and should there be a greater demand for employment floorspace, this could be achieved by extending the units, he determined. However, he found the scheme's impact on protected trees an overriding objection.

DCS No: 34203166; Inspector: Chris Frost; Inquiry.
