The council had approved the scheme subject to conditions preventing the uses from taking place before 9.30am and after 9.30pm, fearing that any additional hours would harm the amenity of nearby residents. The inspector noted that the building was substantial and lay on a busy road. In his view there was no basis for limiting the hours of use or the types of leisure activity that could be carried on within it. He ruled that any class D2 assembly and leisure use would be acceptable and amended the permission accordingly.
