CASEBOOK: Appeal cases - Commercial and industrial - Car storage compound blocked on safety grounds

An enforcement notice directed against the use of agricultural land in Lincolnshire for storage of unlicensed vehicles imported into the UK prior to distribution to car dealers has been upheld, with an inspector concluding that it undermined highway safety on the narrow roads leading to the site.

At the time of the appeal, the site contained 18 vehicles, and three transporters visited the site monthly. The inspector noted that no arguments had been advanced as to why a rural location was required and judged that the lanes were inadequate to accommodate large vehicles. In dismissing the appeal, he awarded costs against the appellant due to his failure to attend the hearing on the scheduled date, necessitating an adjournment.
