The condition required that the dwelling be occupied by a person with a minimum of ten years' permanent residence in the parish or who was required to be in close proximity to another person having a similar period of residence. In accepting that the condition had been properly imposed, the inspector agreed that there was a continuing need for local affordable housing.
No attempt had been made to market the property with the condition in place, she noted. While appreciating that the appellants wished to maximise the value of the house to buy a larger home, she did not find this a compelling reason to sanction removal of the condition, commenting that the same argument could be repeated too often.
