CASEBOOK: Appeal cases - Listed Buildings - Interim condition limiting demolition lifted

A condition preventing the demolition of conservation area buildings in Hertfordshire until a contract had been let for site redevelopment has been removed after an inspector accepted that there would be no serious loss of outlook for adjoining occupiers.

The development involved the removal of former school buildings in a town centre conservation area. The local authority argued that without such a condition an ugly gap would be left, thereby harming the outlook from nearby sheltered housing. The inspector considered that normally such a condition would be desirable but that in this case the buildings had only a limited visual presence in the conservation area as a whole.
