CASEBOOK: Appeal cases - Housing: New Build - Housing rejected on proposed railway route

A housing development proposed on 2.16ha of tipped former railway sidings in Glasgow has been rejected because the site lay on the line of a rail transportation route reservation, even though the site was identified as a residential opportunity in an outdated local plan.

The former plan had been adopted in 1986 but had been superseded by the Glasgow City Plan. The reporter noted the developer's frustration that planning officers had continued to discuss the original housing application without reference to the changing policy situation. However, she felt that this failing was not one for her but rather the Scottish public services ombudsman.
