CASEBOOK: Court cases - University extension permission judged sound

The Court of Appeal has upheld an inspector's decision to grant permission for London Metropolitan University to build additional student accommodation in north London, rejecting a challenge from a local resident that an environmental impact assessment should have been undertaken. The High Court had previously dismissed the challenge, with Mr Justice Lightman ruling that it was "doomed to failure." Lord Justice Simon Brown agreed, concluding that the inspector had made no error. Evans v First Secretary of State and Others; Date: 23 October 2003; Ref: C3/2003/0613.
