The greenfield site comprised the second phase of a housing site under construction following a successful appeal and agreement over highways contributions. Relying on adopted supplementary planning guidance (SPG), the council referred to a need for a new primary school and locally accessible community facilities akin to the local centre provided in conjunction with a nearby new housing development. The reporter, however, noted that the community infrastructure necessary to support allocated sites had already been evaluated and set out in the development plan and reference in SPG to new schools applied only to windfall greenfield sites. She found no evidence to support additional requirements being necessary to make the development acceptable, and addressing deficiencies in the wider area would not pass the tests of Circular 3/2012 Planning Obligations.
The reporter found a roads contribution for the whole site had already been secured in the first phase and although the road layout made provision for bus access the development plan did not specify a requirement to provide a bus service. She stated that a contribution towards enhancing existing schools to accommodate the needs of the development was all that could be required to address school capacity and concluded that she intended to grant permission subject to a suitable legal agreement providing for this.
