Development Management Answers: Foreshore development query

Q Would it be lawful to include areas of foreshore between mean low and high water within a neighbourhood planning area and for neighbourhood plan policies to promote development, such as permanent workshops for artists and craftspeople, thereon? PB

Development Control Practice 3.161 deals with the issue of foreshore and marine development. Planning jurisdiction extends to the low water mark, so it would be lawful to promote your proposed development via a neighbourhood plan. The area beyond the low water mark is covered by the separate marine planning regime. You would of course have to ensure that the land on which your development is proposed falls within the designated neighbourhood area for the neighbourhood plan. John Harrison
