Development management answers: Fee dispute inquiry

Q Planning legislation stipulates that, to benefit from the "free go" application fee provision, a revised planning application must be submitted by the same applicant and be of the same character and description. If an application is refused for a two-storey extension and the same applicant resubmits for a single-storey extension to address the council's reason for refusal, surely this should not be considered to be of a different character and description? JM
