Maidstone Borough Council - CIL charging schedule adopted

Maidstone Borough Council adopted its Community Infrastructure Levy charging schedule on 25 October 2017.

Maidstone Borough Council has decided to adopt its CIL charging schedule on 25 October 2017. The levy will be implemented in the Borough from 1 October 2018.

Previous Progress

Maidstone Borough Council published its CIL preliminary draft charging schedule for a consultation that ran between 21 March 2014 and 7 May 2014. The preliminary draft charging schedule had proposed two residential charging zones, with two rates of £35 per m2 for brownfield sites and £84 per m2 for greenfield sites in one zone, and a rate of £126 per m2 for all developments in another zone.

The preliminary draft had two retail development charging zones with a nil rate in one zone, and a rate of £189 per m2 for small scale developments and a rate of £260 per m2 for large scale developments in the other.

Maidstone Borough Council then published its CIL draft charging schedule for a consultation that took place between 5 August 2016 and 16 September 2016. The draft charging schedule changed the way that residential developments would be charged so that there were three zones with rates of £93, £99 and £77 per m2.

The draft introduced a rate of £45 per m2 for retirement and extra care housing developments. The draft charging schedule makes the charge for convenience retail developments Borough-wide and reduces the charge to £150 per m2. The draft charging schedule applied two charging zones for comparison retail developments with rates of £75 and £0 per m2.

Maidstone Borough Council submitted their draft charging schedule for examination on 24 April 2017, and examination hearings were held on 14 June 2017.

The Examiner's report on the Maidstone CIL charging schedule was issued to the Council on 31 July 2017. The Examiner found that the charging schedule would provide an appropriate basis for the collection of the levy, provided minor modifications were made.

Adopted rates include:

- Three residential charging zones with rates of £99, £93 and £77 per m2.

- Retirement and extra care housing will be charged £45 per m2.

- Wholly or mainly convenience retail development will be charged £150 per m2.

- Two wholly or mainly comparison retail charging zones with rates of £75 and £0 per m2.

- No charge for all other uses.
