Gym noise mitigated after local residents complained

Following the introduction of a gym into a workshop situated close to residential properties in greater Manchester, the appellant agreed following a noise abatement notice being issued, and as part of the appeal to introduce mitigation measures and limit the hours of use.

Past noise complaints and the noise abatement notice placed the onus on the appellant to prove that the gym would not be unacceptable an Inspector held. Sound proofing measures had been introduced in March 2017 which followed the recommendations of an acoustic engineer’s report and at his site visit the Inspector did not hear any low frequency music sounds which were typically played in the gym. A condition requiring the implementation of a management strategy to limit noise breakout was imposed along with limiting opening hours.
