Definitive ruling on housing supply policies

The Supreme Court has re-affirmed a ruling of the Court of Appeal in respect of how paragraph 49 of the NPPF should be applied under circumstances where a five-year supply of housing land could not be demonstrated. In so doing it also confirmed that a narrow definition of policies which restrict the supply of new residential developments should be applied.
