This Development Management Practice Note is designed to guide planning officers and relevant users through the legislative requirements relating to the use of planning agreements and deals primarily with procedures as well as good practice.
The Note states that as a guiding principle the use of agreements should be considered as early as possible in the design and decision making process. An agreement does not, in itself, confer planning permission nor does it determine the outcome of a related application.
When considering the use of a planning agreement, it is fundamental to assess if the agreement sought or offered is necessary in planning terms, directly related to development with a functional or geographical link and related in scale and kind to the development.
