Planning obligation required to secure affordable housing

An inspector has refused to accept that a condition could be imposed to secure affordable housing on a 26 unit scheme in Lincolnshire concluding that a planning obligation was required.

A condition the inspector held would not set out legal covenants governing the expected actions of individuals and their successors in title during future transactions of the affordable units. It would therefore be less effective than an obligation and since the appellant had not provided one the appeal was dismissed.
