South Somerset District Council - CIL examination report published

South Somerset District Council published its Community Infrastructure Levy examination report on 19 October 2016.

The Examiners report on the South Somerset CIL draft charging schedule was issued to the Council on 19 October 2016. the Examiner found that the draft charging schedule would provide an appropriate basis for the collection of the levy in the District.

Previous Progress

South Somerset District Council had published its CIL preliminary draft charging schedule for consultation between 7 March 2012 and 4 April 2012. The preliminary draft had proposed three residential charging zones with rates of £150, £100 and £32 per m2. The draft had also proposed to charge £200 per m2 for large format retail developments.

South Somerset District Council had published its CIL draft charging schedule for a consultation that ran between 10 February 2016 and 24 March 2016. The draft reduced the rates proposed in the preliminary draft. The draft proposed two residential (C2&3) charging zones with rates of £40 per m2 and a nil rate. It also reduced the proposed rate for supermarket, superstore and retail warehouse developments to £100 per m2 and only charges this in one zone and only when they are convenienced based.

South Somerset District Council submitted its CIL draft charging schedule along with a statement of modifications for examination on 27 May 2016. The statement of modifications was available for comment until 24 June 2016.

The modifications included not including C2 residential developments in the residential development charging zone. Another modification was to make clear that retail developments that are not convenience based supermarkets, superstores or retail warehouse developments would not be charged anywhere in the District.

Examination hearings were then held on 9 August 2016.

Proposed rates include:

- Two residential development (C3) charging zones with rates of £40 and £0 per m2.

- Two convenienced based supermarket, superstore and retail warewarehose development charging zones with rates of £100 and £0 per m2.

- No charge for all other uses.
