Mole Valley District Council - CIL charging schedule adopted

Mole Valley District Council adopted its Community Infrastructure Levy charging schedule on 11 October 2016.

Mole Valley District Council formally deceided to adopt its CIL charging schedule on 11 October 2016. The levy will be implemented in the District from 1 January 2017.

Previous Progress

Mole Valley District Council had published their first preliminary draft charging schedule that was consulted upon between 8 March 2013 and 26 April 2013. The 2013 preliminary draft had proposed one district wide charge of £125 per m2 for residential developments.

The 2013 preliminary draft had also only proposed convenience retail developments and at a lower rate of £100 per m2. This preliminary draft did not propose to charge hotel developments.

Mole Valley District Council then published their next preliminary draft charging schedule for consultation that took place between 6 August 2015 and 18 September 2015. This revised preliminary draft had the same rates as the draft, except that it also proposed to charge hotel developments £20 per m2, and did not propose a reduced rate for small scale residential developments.

Mole Valley District Council then published their CIL draft charging schedule for a consultation that ran between 16 December 2015 and 29 January 2016.

Mole Valley District Council submitted its CIL draft charging schedule to the Secretary of State for examination on 29 February 2016. The draft charging schedule was the same draft that had been available for consultation in December 2015.

On 18 May 2016 a hearing session was held on the submitted draft charging schedule. As a result of the hearing session and a change to how affordable housing contributions can be sought the council published a modified draft charging schedule.

The modified draft charging schedule was available for consultation until 17 June 2016. The modification was to remove a lower rate of £50 per m2 for small scale residential developments in one zone, and replace it with the rate of £175 per m2 as other residential developments in that area would be charged.

The Examiner's report on the Mole Valley CIL draft charging schedule was issued on 14 July 2016. The Examiner found that the modified draft charging schedule provided an appropriate basis for the collection of the levy in the District.

Adopted rates include:

- Two residential charging zones with rates of £250 and £175 per m2.

- Convenience retail developments will be charged £140 per m2.

- Two comparison retail development charging zones with rates of £140 and £0 per m2.

- No charge for all other uses.
