Condition on planning permission prevents office conversion

Permitted development rights under Class O of Part 3 to Schedule 2 of the GPDO 2015 were restricted by a condition thereby preventing the conversion of an office block in west Sussex to 35 flats, an inspector decided.

The condition stated that the premises should not be used for any other purpose other than light industrial use and the offices and storage areas should be ancillary to such a use. The inspector decided that the condition was specific and clear in its terms. Since article 3(4) of the order prevented permitted development rights from applying where a specific condition had been imposed on a planning permission, the conversion was not permitted. The appeal was dismissed.
