Part 1 of the 2015 Act makes provision for the Secretary of State to appoint a strategic highways company to act as the highway authority in respect of the areas and highways specified in the appointment. The Appointment of a Strategic Highways Company Order 2015 appoints Highways England Company Limited as a strategic highways company for the strategic road network in England.
The main provisions include:
- Amending subordinate a number of planning and other instruments in consequence of the appointment of Highways England. In general the effect of the amendments is to allow the company to exercise the functions and powers of a highway authority under various highways-related and other enactments.
- Containing general transitional provisions for the transferring of functions from the Secretary of State to Highways England. In effect the relevant functions being done by the Secretary of State on 1st April 2015 may be continued by the company.
- As of 1st April 2015, the company will be responsible for discharging the litter clearance and cleaning duties which previously were transferred to the Secretary of State.
