Watford Borough Council adopted its CIL charging schedule at a meeting of its Full Council held on 11 November 2014. The levy will be implemented from 1 April 2015.
The preliminary draft charging schedule had been published on 18 March 2013 for a consultation that ended on 15 April 2014. In the preliminary draft the nil rate for Major Development Areas was restricted to residential developments.
The preliminary draft also proposed to charge all retail developments £120 per m2. The charge for specialist accommodation would have applied more broadly to all private care home developments in the preliminary draft.
The draft charging schedule was published for a consultation that was held between 17 February 2014 and 31 March 2014. The draft charging schedule introduced a lower charge of £55 per m2 for retail within primary shopping areas, and applied the nil rate for Major Developed Areas to all development types.
The draft charging schedule was then submitted for examination on 15 April 2014. A Statement of Modifications was published just prior to submission of the draft charging schedule on 11 April 2014 and was availble for consultation during the examination until 14 May 2014.
The modifications in the Statement of Modifications included clarification of what care homes would be charged CIL, along with updating its annex on how to calculate the chargable amount to reflect the changes to CIL regulations brought in in February 2014.
The Examiner's report published on 18 August 2014 concluded that the submitted draft charging schedule along with the Statement of Modifications provided an appropriate basis for the collection of CIL for Watford Borough Council.
Adopted rates include:
- Two residential including care home and hotel development charging zones with rates of £120 and £0 per m2.
- Three retail charging zones with rates of £120, £55 and £0 per m2.
- No charge for all other uses.
