Blanket restriction on house extensions determinative

Having regard to an article 4 direction issued by a local authority in west London an inspector has decided that a single storey extension to a dwellinghouse was not permitted development.

The council had issued the direction which covered the whole of the borough. It prevented the enlargement of a dwelling where this consisted of a single storey extending beyond the rear wall by more than four metres, which no longer benefited from rights conferred under Paragraph 4.4 of Part 1 to schedule 2 of the GPDO 1995. Consequently, the appeal had to fail the inspector ruled because what was proposed by the appellant was no longer permitted development.
