Leeds City Council - CIL charging schedule adopted

Leeds City Council adopted its Community Infrastructure Levy charging schedule on 12 November 2014.

Leeds City Council formally adopted its CIL charging schedule at a meeting of its Full Council on 12 November 2014. The charging schedule will be implemented from 6 April 2014.

Previous Progress

The preliminary draft charging schedule was published for a consultation that ran between 27 March 2013 and 15 May 2013. The charges for all large scale retail developments was higher in the preliminary draft charging schedule with rates of £248 and £158 per m2. The charge for city centre offices was also slightly higher at £40 per m2.

The draft charging schedule was then published on 29 October 2013 for a consultation that ended on 10 December 2013. The draft charging schedule reduced the rates for large scale retail and split the charges for comparison and convenience retail.

Leeds City Council submitted its CIL draft charging schedule incorporating the Statement of Modifications for examination on 7 April 2014. The Statement of Modifications  was also published for consultation at the same time as submission for a consultation that ran from 7 April 2014 and 6 May 2014. The modification to charges included changing the charge for large convenience retail to just being a charge for supermarket developments.

Hearing sessions were then held on 3 June 2014. During the hearing sessions the Examiner and the Council agreed to the modifications to the plan, to clarify the position of the CIL charging schedule as well as correcting errors in the text.

The Examiner's report on the Leeds City Council CIL draft charging schedule had found that it provided an appropriate basis for the collection of the levy in the City.

The Examiner also recommended that some modifications put forward by the Council be incoporated into the adopted charging schedule. These modifications include changing the availability of the maps, deletion of now redundant references and clarification of how CIL will relate to Section 106.

Adopted rates include:

- Four residential charging zones with rates of £5, £23, £45 and £90 per m2.

- Two charging zones for supermarket developments with rates of £110 and £175 per m2.

- Two charging zones for large comparison retail with rates of £35 and £55 per m2.

- City centre offices will be charged £35 per m2.

- Publicly funded or not for profit developments will not be charged CIL.

- All other uses will be charged £5 per m2.
