Small relaxation allowed at motocross circuit

The terms of a condition imposed on a planning permission for the use of land in Wiltshire for motocross events was varied slightly to enable the appellant greater flexibility in its use.

The existing condition restricted the total number of events to 14 in any year with no more than two events in any month. However the appellant stated that the motocross season was restricted to around seven months per year and the existing condition provided no opportunity to re-schedule cancelled events due to unforeseen circumstances such as excessive rain. In practice this meant that the circuit would be used fewer than 14 days per year as permitted under the terms of the consent.

In examining the evidence the inspector accepted the council’s claim that it was necessary to protect local residents from excessive noise and preventing frequent events. But some flexibility was justified given that the use of the site for motocross events had been accepted. Consequently retaining the total number of events at 14 was reasonable but he allowed up to 3 events per month but with no more than two event days over any individual weekend and no more than two events days on consecutive weekends.
