Welsh Government consultation on the power to override easements

The Welsh Government is seeking views on the proposal to amend a number of legislative provisions.

The Welsh Government is considering amending, by order, the provisions contained in the following Acts:

  • Paragraph 6 of Schedule 28 to the Local Government, Planning and Land Act 1980
  • Section 19 of the New Towns Act 1981
  • Paragraph 5 of Schedule 10 to the Housing Act 1988
  • Section 237 of the Town and Country Planning Act 1990.

They plan to make an order under section 203 of the Planning Act 2008.

This will allow restrictive covenants or other rights on land, which has been acquired or appropriated by a public authority, to be overridden for the use of the land. For example, on a permanent basis and not just for the carrying out of works on that land.
