Conditions on flat conversion deleted as unnecessary

A range of conditions imposed on a prior approval under Class J of Schedule 2 of the GPDO 2013 authorising the conversion of an office building to flats in west London was deleted because they were unnecessary.

The disputed conditions related to transport, highway, flood risk and contamination and required the appellant to submit various additional details and to prevent future occupiers from applying for car parking permits. An inspector held that the scheme would not lead to a material increase in parking stress, and cycle and refuse storage could be provided without detriment to highway safety. Although the site lay within flood zone three it was protected by a defence system and while non-return values should be fitted to one flat no other measures were necessary, the inspector decided. Nor was there any likely risk to future occupiers as a consequence of the site comprising unmade ground since there was no need to dig additional foundations.
