Petrol station hours extended despite amenity fears

The opening hours of a petrol station on the Wirral were extended despite the council claiming that it would undermine the amenity of local residents.

The petrol station opened between 7am and 11pm each day and the appellant sought to extend this to allow one hour more at night and an hour earlier in the morning.

There was little in the council’s evidence to suggest that the additional hours would give rise to disturbance, the inspector noting that a jet car wash facility was controlled under another planning permission and had more restricted hours of use.

The area was dominated by traffic noise and provided the use of air and water facilities and the vacuum were limited to existing hours, the scheme was acceptable.
