Mobile Homes (Wales) Act 2013

An Act of the National Assembly for Wales has been issued which reforms and restates the law relating to mobile home sites in Wales.

The Act amends the Town and Country Planning Act 1990 in the following ways
  • In section 71(4), after "caravan site" insert "or under Part 2 of the Mobile Homes (Wales) Act 2013 authorising the use of the land as a site for mobile homes (within the meaning of that Act)".
  • In section 191(7)(a), after "1960" insert "or section 7(1) of the Mobile Homes ( Wales ) Act 2013;".
 
With regard to the duration of agreements relating to pitches (except those on local authority gypsy and traveller sites) the Act states "If planning permission for the use of the protected site as a site for mobile homes has been granted in terms such that it will expire at the end of a specified period, the period for which the right subsists does not extend beyond the date when the planning permission expires."
 
With regard to the duration of agreements relating to transit pitches (except those on local authority gypsy and traveller sites) the Act adds "If planning permission for the use of the protected site as a site for mobile homes has been granted in terms such that it requires the owner to limit the duration of stay for mobile homes on the site, the period for which the right subsists does not extend beyond that duration."
