Retail reversion offer held incapable of enforcement

A proposed takeaway on Teesside has been refused permission after an inspector found no guarantees that the operator's present premises next door would be returned to retail use.

The inspector decided that the appeal could not be allowed subject to a condition requiring the resumption of retail use in the existing takeaway because this would not be enforceable. There was nothing to stop the premises being sold to another party who might wish to continue the current takeaway use, he reasoned.
