The council had taken its decision on the basis of the 2003 aviation white paper, which forecast that air passengers would double nationally by 2030. The group argued that new factors were highly relevant to the decision, including the Climate Change Act 2008 and new targets for aviation emissions introduced in 2009.
It argued that the council should not have relied on outdated policy. But Mr Justice Collins pointed out that, for good or ill, the government had maintained the white paper as the relevant policy document. It could not be an error of law to follow it, he held.
