The High Court blocks developer's claim

The High Court has blocked a developer's claim that a 1974 planning permission for 19 flats in Torquay allows it to go ahead with a contemporary development.

Greyfort Properties Ltd's application for a lawful development certificate for the site on Parkhill Road was rejected by Torbay Council and an inspector, on the grounds that the permission had not been lawfully implemented.

Mr Justice Mitting backed the decision, finding that the original developer had not met a condition requiring ground-floor levels to be agreed with the local authority.
