A previous appeal had been dismissed on the grounds that the development would reduce neighbours' privacy. To tackle this, the appellants proposed to obscure glaze bathroom and ground-floor kitchen windows to prevent views into and out of the property. The second inspector decided that a suitable form of glass could be installed to meet privacy concerns without compromising the character of the street.
Although the distance between habitable facing rooms fell below the council's standard requirement of 22m, the inspector accepted that this did not warrant dismissing the appeal. She rejected the appellants' claim for a full costs award. The council's argument that obscure glazing would look out of character was a matter of judgement and the issues raised were not identical to the previous appeal, she concluded.
