DC Casebook: Community Facilities - Gospel hall held to damage local amenity

The demolition of a house in a primarily residential area in Lincolnshire to allow construction of a gospel hall has been ruled unacceptable because of the potentially adverse impact on local residents.

The hall would serve seven families comprising 27 people. The inspector found nothing manifestly inimical in locating the use in the area but was concerned that Sunday services between 6am and 7pm would cause disturbance through the coming and going of vehicles and worshippers. Even if great care were exercised, he did not believe it would be possible to drive into and out of the car park, open and close vehicle doors and start engines without adversely affecting nearby residents' amenity.
