The RTPI conduct and discipline panel recently found a consultant member in breach of the code of conduct by allowing a conflict of interest to arise in the course of their professional duties.
While employed by one private practice, the member was involved in the preparation of a planning application for a large development proposal. The member then left to join another practice and almost immediately submitted an objection document in respect of the same planning application. The panel agreed that the member had failed to take reasonable precautions to ensure that no conflict of duty would arise and had personally endorsed differing professional views. It agreed that the member had breached paragraphs 3 and 4 of the code and byelaw 7(2), which states that members shall not make or subscribe to statements or reports that are contrary to their own professional opinion and shall take steps to ensure that no conflicts of interest arise during the course of their professional duties. As a result, the panel agreed that the member should be reprimanded but not named in the published report.
