Council appeal panels condemned by expert

A planning expert today slammed proposals in the Planning Reform Bill to transfer many planning appeals to local councillors.

Under proposals in yesterday's Planning Bill, appeals against decisions made by council officers would be decided by a panel of councilors.

The move has been made in an attempt to reduce the workload for the Planning Inspectorate, which currently decides all appeals.

But Rynd Smith, RTPI policy director said: "We are significantly concerned that this gives to the appellant something that it does not want - a politicized appeals process.

"At the moment, they get an independent review which listens to both sides. In effect, if councilors are deciding appeals against their officers' decisions, this will be an appeal from Caesar to Caesar."

Decisions of the councillor panel would be challengeable only in the High Court under specific conditions, the bill said.
