Election planning decision ruled unlawful

Plans for a housing and leisure development approved during the run-up to last year's council elections have been overturned by the High Court.

The Coatham Enclosure scheme in Redcar had been challenged by protesters, who claimed the permission was unlawful because the decision was taken during the local election purdah period.

The Friends of Coatham Common are demanding an investigation into Persimmon Homes' £90 million scheme for a leisure centre and 357 homes.

They have been campaigning against the housing element of the plans for several years.

Redcar MP Vera Baird blamed the former Liberal Democrat and Tory council coalition for holding the meeting in the "politically charged environment of an election campaign".

But a Redcar and Cleveland Borough Council spokesman said: "The planning committee is not party whipped and the vast majority of planning authorities will still have meetings within purdah."

He said the council was now deciding whether to appeal.

The scheme had only received a £1.479m grant from regional development agency One NorthEast, in December.
