Inspector fails to allow parties chance to respond on independent dwelling conclusion

An inspector's decision to uphold an enforcement notice alleging that an extension to a garage block associated with a dwelling in the green belt, did not fall within permitted development limits under Class E of Part 1 to Schedule 2 of the GPDO 1995, was quashed by the High Court, judge Robin Purchas QC concluding that the appellant and local authority had not been given the opportunity to comment on critical aspects of the inspector's reasoning.
