Legal viewpoint: The murky waters of 106 repayments

Two recent High Court cases have dealt with repayment clauses in section 106 planning obligations. Last November, in Hampshire County Council v Beazer Homes, the court considered whether the developer was entitled to a refund of the unspent portion of a section 106 contribution towards highway works associated with a major development at Fleet.
