A proposal to replace a former dwelling in Devon has been refused even though the local planning authority had previously granted planning permission for a similar development at the site.
The original dwelling had been demolished in 2000, after which the council granted permission for a replacement. The inspector found that this had lapsed, so the scheme should be considered as a new dwelling in the countryside. He noted that PPS3 makes it clear that previous permissions do not establish a presumption in favour of schemes that conflict with rural protection policies.
