The change of use of a building in the East Riding countryside to a day nursery has been dismissed by an inspector on the grounds that it is an unsustainable form of development.
The scheme involved the conversion of a large detached outbuilding in the garden of a house close to a small market town. The local authority claimed that the use should be sited in an existing settlement, thus maximising the potential for parents to access it by non-car means of transport.
The inspector agreed that accommodating up to 40 children at the site would lead to a considerable number of trips by car. Although the appellant offered to operate a minibus, he reasoned that the majority of parents would still prefer to use their own cars. The use would be contrary to sustainable development principles, he ruled.
