Sainsbury's Supermarkets Ltd has had mixed success in trying to persuade an inspector to relax delivery time conditions at a Somerset store.

The condition banned vehicle deliveries before 6.30am and after 10pm on weekdays and Saturdays and at any time on Sundays and bank holidays. Sainsbury's sought to vary this to allow deliveries between 8am and 5pm on Sundays and one delivery on Mondays to Saturdays between 5am and 6.30am. It also sought permission for deliveries between 9am and 5.30pm on Sundays and bank holidays for a temporary period of six months.

The inspector noted that retail activity now forms an integral part of weekend life on Sundays. However, he decided that an early morning delivery would adversely affect local residents' amenity and acoustic screening around the delivery yard would not be sufficient to mitigate the impact. This appeal had to fail, he decided. He found the second proposal acceptable provided it was limited to a six-month trial during which the effects could be assessed.
