DC Casebook: Householder Development - Stabilisation work agreed on landslip site

Householder development

Planning, 16 May 2008

The retention of retaining walls in the rear garden of a house in West Yorkshire has been permitted after an inspector ruled that they were structurally stable and would not undermine the character of the area.

Following a series of landslips in the steeply sloping rear garden, the appellant had undertaken works to stabilise the land. The project involved two structures comprising stone-filled gabion walls, one of which was up to 2.9m high. The appellant explained that these were required in order to protect the integrity of two terraces used for parking and as a garden.

The inspector acknowledged that the works were largely screened from public viewpoints and views would be further reduced following the completion of an adjacent housing estate. He was satisfied that a landscaping scheme would soften the impact of the walling, especially if it showed details of how the tops of the walls could be treated through an appropriate capping material.
