An inspector has quashed an enforcement notice and granted permission for the retention of an agricultural worker's caravan at a fish farm in Devon after deciding that a longer period should be allowed for the appellant to demonstrate the business's viability.
The appellant explained that he had been too hasty in stocking a pond built in 2004 in six months, instead of allowing for a ten-month stabilisation period. As a consequence, 11,000 fish died and this had a substantial effect on the business's fiscal position. In addition, the building of two more ponds had been delayed due to subsidence following last summer's heavy rain, he claimed.
The inspector agreed that these circumstances were so exceptional as to justify a further temporary period over which the appellant could seek to establish a viable enterprise. He accepted that the appellant needed to live on the site to ensure that the fish remained healthy and safe from theft.
