An inspector has quashed enforcement notices directed against the sale of goods to the public from four units at a trading park in Hampshire but refused to allow a fifth because of the potential impact on a town centre.
The units were occupied by a flooring shop, a decorating centre, a tile warehouse and a business selling party goods. The council claimed that permission for the development restricted their use to class B1 business and B8 storage and distribution with ancillary showrooms. It asserted that the premises had become retail outlets selling goods to the general public rather than trade customers.
The inspector agreed that a mixed use had been established in four of the units. He held that another selling decorating supplies remained within class B8 but decided that there was a quantitative need for the retail floor space. It would be inappropriate to disaggregate the retail and warehouse elements of each mixed use, he found. He granted permission subject to conditions on the nature and extent of the retail elements.
